Question : RESERVATION IN PROMOTION FOR DIFFERENTLY ABLED PERSONS



(a) the existing rules/regulations governing reservations to the differently abled persons in the matter of promotion/recruitment to various categories of posts in Government offices;

(b) whether the Apex Court has given any direction/ruling recently on the issue of reservation in promotion to differently abled persons and if so, the details thereof;

(c) whether the Government has issued instructions for compliance of the Apex Court`s ruling in this regard, if so, the details thereof and if not, the reasons therefor; and

(d) the present status of implementation of the said direction/ruling of the Apex Court?

STATEMENT REFERRED TO IN REPLY TO LOK SABHA STARRED QUESTION NO. 413 FOR 06.08.2014 BY SHRI NANA PATOLE REGARDING RESERVATION IN PROMOTION FOR DIFFERENTLY ABLED PERSONS

(a): As per existing instructions issued by the Department of Personnel & Training, Ministry of Personnel, Public Grievances and Pensions vide Office Memorandum No. 36035/3/2004-Estt.(Res) dated 29.12.2005, reservation to the differently abled persons in the matter of promotion/recruitment to various categories of posts in government offices is as below:


(i) Three percent of the vacancies in case of direct recruitment to Group A, B, C and D posts shall be reserved for persons with disabilities of which one per cent each shall be reserved for persons suffering from
(i) blindness or low vision,

(ii) hearing impairment and
(iii) locomotor disability or cerebral palsy in the posts identified for each disability

(ii) Three percent of the vacancies in case of promotion to Group D and Group C posts in which the element of direct recruitment, if any, does not exceed 75%, shall be reserved for persons with disabilities of which one percent each shall be reserved for persons suffering from (i) blindness or low vision, (ii) hearing impairment and (iii) locomotor disability or cerebral palsy in the posts identified for each disability.

(b) to (d): The Hon’ble Supreme Court in its judgment dated 08.10.2013 in the matter of Civil Appeal No. 9096 of 2013 gave directions primarily on the issue of computation of reservation for persons with disabilities in an identical manner for all groups. Based on the directions of the Hon’ble Supreme Court, suitable amendment to the Office Memorandum No.36035/3/2004-Estt.(Res.) dated 29.12.2005 was made vide Office Memorandum No.36012/24/2009-Estt.(Res.) dated 3rd December 2013.
