STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (c) OF LOK SABHA STARRED QUESTION NO. 85 FOR 08.02.2021 RAISED BY SHRI PRADYUT BORDOLOI REGARDING CHILD AND ADOLESCENT LABOUR (PROHIBITION AND REGULATION) ACT, 1986.
(a) & (b): Labour being in the concurrent list, enforcement of the provisions of Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 is the responsibility of both central and state governments in their respective sphere. Section 17A of the Child & Adolescent Labour (Prohibition & Regulation) Act, 1986 provides for conferring power and imposing duties on District Magistrate for effective implementation of the provision of the Act. Further, Section 17B provides for periodic inspection and monitoring of the implementation of the Act. Hence, the details regarding FIRs filed under the Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 is not maintained centrally. However, on the basis of information received from various State Governments/UTs, the details regarding the number of FIRs filed under the Child and Adolescent Labour (Prohibition and Regulation)Act, 1986 during the year 2020, State-wise is at Annexure-I, the number of children and adolescent labourers rescued during COVID-19, State-wise is at Annexure-II.
(c): The number of children rehabilitated during 2017-18 and 2018-19 on the basis of information received from the State/UT Governments; and during 2019-20 on the basis of information available on the PENCiL Portal, State-wise is at Annexure-III.
