Question : Use of CSR Funds

(a) the details of amount spent on CSR by corporate entities during each of the last three years and current year, State/UT-wise including Bihar, Tamil Nadu and Goa;


(b) whether there are large variations between amount of CSR funds spent among various States, if so, the details thereof and the reasons therefor;


(c) whether the Government has taken/steps or proposes to give priority to less developed States under CSR, if so, the details thereof; and


(d) whether the Government is providing any incentives to corporate entities to ensure that CSR funding is available to developed States including Goa and if so, the details thereof?

(a): As per filings made by the Companies in the MCA 21 registry, details of Corporate Social Responsibility (CSR) spent by Companies during financial years 2015-16, 2016-17 and 2017-18 in different States/UTs including Bihar, Tamil Nadu and Goa are at Annexure.
(b) & (c): Section 135 of the Companies Act, 2013 (Act) mandates every company having net worth of Rs. 500 crore or more, or turnover of Rs. 1000 crore or more, or net profit of Rs. 5 crore or more during the immediately preceding financial year, to spend at least two per cent of the average net profits of the company made during the three immediately preceding financial years, towards Corporate Social Responsibility (CSR) in any of the eligible activities enlisted in Schedule VII of the Act. The spread of CSR spend among various States may be seen at Annexure. CSR is a Board driven process and the Board of the company is empowered to plan, decide, execute and monitor the CSR activities of the company based on the recommendation of its CSR committee. The Government does not issue any directions to Corporates to spend in any particular area or activity.
(d): Under the CSR provisions of the Companies Act, 2013 and rules thereof, no such incentives is provided by the Government to companies.
