Question : Financial Relief to Victim after Registration of FIR

(a) whether any First Information Reports (FIRs) have been registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act in the country, particularly in various police stations of Maharashtra, Madhya Pradesh, Rajasthan and Delhi during the last two years till date and if so, the details thereof;

(b) whether there is any provision under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act for providing financial relief to the victims after registration of FIRs in the police stations and filing chargesheet in the court under the said Act;

(c) if so, the number of said cases in which financial assistance has been provided to the victims as per the provisions of the said Act along with the details of the cases in which the said financial assistance has not been provided, State-wise and police station-wise; and

(d) the action taken against the officers not following the said provision relating to providing financial relief to the victims in cases of FIRs registered under the said Act?

(a) National Crime Records Bureau (NCRB) compiles and publishes information on crimes in its publication “Crime in India”. Published reports are available till

the year 2018. The State/UT-wise (including Maharashtra, Madhya Pradesh, Rajasthan and Delhi) details of cases registered on total crimes committed under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (PoA Act) for crimes against Scheduled Castes and Scheduled Tribes during the years 2017 and 2018 are available at Annexure-I.

(b) Rule 12(4) of the Scheduled Cases and the Scheduled Tribes (Prevention of Atrocities) Rules, 1995 provides for financial relief to the victim.

(c) Relief is provided to the victims under the PoA Act by the respective Social Welfare/SC/ST Welfare Departments of the State Governments/UTs concerned. As per the reports received from the State Governments/UTs, the number of persons provided relief in the years 2017-18 and 2018-19, under the Centrally Sponsored Scheme for implementation of the Protection of Civil Rights Act, 1955 and the PoA Act, is available at Annexure-II. Details of the cases in which the financial assistance has not been provided i.e. State-wise and Police Station-wise is not maintained centrally.
(d) State Governments are responsible for the implementation of PoA Act and the Rules framed thereunder and they are competent to take cognizance in respect of any dereliction of duty by any public servant. Data in this regard is not maintained centrally.
