Question : NON REGISTRATION OF FIR



(a) whether the Government has received complaints with regard to non- registration of First Information Reports (FIRs) by the State Police;

(b) if so, the details thereof and the total number of such cases reported and the action taken against the responsible police officers during each of the last three years and the current year, State-wise including NCT of Delhi;

(c) whether the Apex Court has recently given any ruling in this regard, if so, the details thereof and the reaction of the Government thereto;

(d) whether the Government has issued any advisory to the States and Police departments in this regard, if so, the details thereof and reaction of the State Governments thereto; and

(e) the other measures taken by the Government to ensure registration of every complaint in future and to set up an online system of registering FIR for reporting crimes?

(a) & (b): There have been some reported instances regarding non-registration of FIR. The data of such cases are not maintained centrally by National Crime Records Bureau (NCRB).

(c) & (d): Yes Madam. In the matter of Lalita Kumari Vs Government of Uttar Pradesh & Ors in Writ Petition (Criminal) No. 68 of 2008, the Hon’ble Supreme Court in its judgment dated 12.11.2013 ruled that registration of FIR is mandatory under Section 154 of Cr.P.C. on certain cases of crime. In this regard, Ministry of Home Affairs has issued an Advisory regarding Compulsory Registration of FIR u/s 154 Cr. P. C. when the information makes out a cognizable offence on 5-2-2014, which is available on the website of MHA (http://www.mha.nic.in/).

(e): Crime and Criminal Tracking Network and System(CCTNS) project, a Mission Mode project of Ministry of Home Affairs to provide an online citizen services portal through which citizens can lodge their complaints and track the status of those complaints and there is no provision for online registration of FIRs in the CCTNS project. ‘Police’ and ‘Public Order’ are State subjects under the seventh Schedule to the Constitution of India and therefore, the State Governments are primarily responsible for prevention, detection, registration and investigation of crime and for prosecuting the criminals through the machinery of their law enforcement agencies as also for protecting the life and property of the citizens. The Union Government, however, attaches highest importance to the matter of prevention of crime and therefore, has continued to urge to the State Governments/UT Administrations to give more focused attention towards improving the administration of criminal justice system and taking such measures as are necessary for prevention and control of crime.
