(a) to (e) : A Statement is laid on the Table of the House.
STATEMENT REFERRED TO IN REPLY TO LOK SABHA
STARRED QUESTION NO. 286* FOR 4TH AUGUST, 2017
(a) Statements showing the details are at Annexure I & II
(b) The Central Educational Institutions (Reservation in Admission) Act, 2006 provides 15, 7.5 and 27 percent reservations in admission of the students belonging to the SCs, STs and OBCs, in certain Central Educational Institutions established, maintained or aided by the Central Government. Accordingly the above reservation quota is being implemented in the Central Government institutions under the control of the Ministry of Health & Family Welfare.
The reservation policy in respect of the Institutions coming under the purview of the State Governments is the concern of the respective State Government.
Further, the students belonging to reserved categories viz. SC, ST and OBC securing 40th percentile score or above in National Eligibility cum Entrance Test (NEET) are eligible for admission to MBBS/BDS Course whereas students of General Category have to secure minimum 50th percentile or above for the same.
(c ) & (d) State wise details of number of seats given to SC, ST and OBC candidates in MBBS and BDS courses in 2016-17 are given in Annexure III & IV.
Seats allocated for reserved categories are filled by eligible candidates of respective categories.
(e ) Representations/references have been received in recent past about non reservation of 27% seats for OBCs in Government Medical Colleges of the State Governments and in All India Quota. Each State has its own reservation policy and 27% reservation for OBCs provided under The Central Educational Institutions (Reservation in Admission) Act, 2006 is applicable only to certain Central Educational Institutions established, maintained or aided by the Central Government.
The matter relating to 27% reservation to OBC under All India Quota of 15% in UG seats and 50% in PG seats is sub-judice in the matter of Saloni Kumari and anr Vs DGHS and others –WP(C) no 596 of 2015 before the Supreme Court.
