Question : CONVENTION ON SUPPLEMENTARY COMPENSATION



(a) whether India has submitted its instrument of acceptance to the Convention on Supplementary Compensation for Nuclear Damage (CSC), relating to liability and compensation for damage caused by a nuclear accident;

(b) if so, the details thereof;

(c) whether the Civil Liability for Nuclear Damage (CLND) Act allows India joining any international nuclear liability regime such as CSC; and

(d) if so, the details thereof?

(a) No.

(b) Does not arise.

(c) & (d) Yes. The CLND Act provides the basis for India joining an appropriate international liability regime such as the Convention on Supplementary Compensation for Nuclear Damage (CSC) of 1997. Article XVIII of the CSC states that a State that is not a Party to either the Vienna Convention or the Paris Convention, or a State which declares that its national law complies with the provisions of the Annex to this Convention, can become a Party to the Convention. India not being party to the Vienna or the Paris Conventions signed the CSC on 29 October 2010 on the basis of its national law namely the CLND Act. However, India has not yet ratified the CSC.
