Question : ORDINANCES BY GOVERNMENT



(a) the details of ordinances issued by the Government during the last nine months along with the reasons therefor;

(b) whether the Government has also issued an ordinance amending the Land Acquisition Act;

(c) if so, whether the Government had consulted with various stakeholders regarding the said amendments in Land Acquisition Act and if so, the details thereof;

(d) whether the Government has come across the protest from various stakeholders against the ordinance on Land Acquisition Act; and

(e) if so, the details thereof and the reaction of the Government thereto?

(a) and (b):Yes Madam. As the Houses of Parliament were not in Session and the circumstances required taking immediate action, the following Ordinances were promulgated during the last nine months:

1. The Telecom Regulatory Authority of India (Amendment) Ordinance, 2014 (3 of 2014)

2. The Andhra Pradesh Reorganisation (Amendment) Ordinance, 2014 (4 of 2014)

3. The Coal Mines (Special Provisions) Ordinance, 2014 (5 of 2014)

4. The Textile Undertakings (Nationalisation) Laws (Amendment and Validation) Ordinance, 2014 (6 of 2014)

5. The Coal Mines (Special Provisions) Second Ordinance, 2014 (7 of 2014)

6. The Insurance Laws (Amendment) Ordinance, 2014 (8 of 2014)

7. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Amendment) Ordinance, 2014 (9 of 2014)

8. The Citizenship (Amendment) Ordinance, 2015 (1 of 2015)

9. The Motor Vehicles (Amendment Ordinance), 2015 (2 of 2015)

10. The Mines and Minerals (Development and Regulation) Amendment Ordinance, 2015 (3 of 2015)

(c) : Many State Governments and Ministries/Departments of Government of India have expressed some difficulties in the implementation of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and expressed the necessity of making changes in the said Act. Accordingly, a Conference of State Revenue Ministers was organised in VigyanBhawan on 27th June, 2014 under the Chairmanship of Shri NitinGadkari, Hon`ble Minister of Rural Development in which 32 States and Union territories have been participated. Besides, representations were also received from other stakeholders, which were also considered.

(d and (e): Number of representations have been received expressing concerns about the farmers interests etc., and they are being considered by the Government.
