Question : Works under CSR in Rajasthan

(a) whether the private companies, multinational companies and Semi Government Organisation are undertaking the work of toilet construction under Corporate Social Responsibility (CSR) so as to make our country free from open defecation and clean;

(b) if so, the details of the number of toilets constructed since the year 2014 till now under CSR, State/UT-wise;

(c) the details of the public sector and private companies functioning in Rajasthan as on date and whether these companies or there ancillary companies have done any work under (CSR);

(d) if so, the details thereof along with the works including toilet construction, number of beneficiaries and the locations where works under CSR have been taken up including by private companies in various districts of Rajasthan including Udaipur since the year 2014 till now; and

(e) the country-wise details of funds spend during the last three years and the current financial year?

(a) and (b) : Section 135 of the Companies Act 2013, mandates every company above the specified thresholds of turnover, or net worth, or net profit to spend at least two per cent of the average net profits earned during three immediately preceding financial years on Corporate Social Responsibility (CSR) activities specified in Schedule VII of the Act. Separate data on the expenditure on number of toilets constructed is not filed by companies as per the CSR Policy Rules.

Toilets can be taken up under the heads like Sanitation or Rural development or Slum area Development under Schedule VII. As per information of 7334 and 5097 companies for the years 2014-15 and 2015-16 respectively analysed by the Ministry, the sector-wise expenditure is given at Annexure.

(c): There are 35218 number of Companies registered in the state of Rajasthan as on 31.07.2017. From the analysis of 7334 and 5097 companies for the FY 2014-15 and 2015-16 respectively, the details of CSR expenditure by companies registered in the state of Rajasthan is as under:

(d) : Rule 8(1) in Companies (Corporate Social Responsibility Policy) Rules, 2014, prescribes the format of annual disclosure on CSR in the Board’s Report, which includes disclosure w.r.t. works, development sector, state in which CSR work has been undertaken etc. The Annual Reports including the Boards Report of the companies are available on the Ministry’s website (www.mca.gov.in).

(e) : No such information is maintain by Ministry of Corporate Affairs.
