Question : Compensation to Owners of Plots in Vicinity of Ammunition Depots

(a) whether as per guidelines / instructions there are restrictions regarding construction of any asset around Ammunition Depots in the country;

(b) if so, the details thereof along with the details of affected Cantonments especially Ammunition Depots in Barmer and Jaisalmer Districts of Western Rajasthan and Haryana;

(c) whether a large number of plots are falling within the ambit of 300 metres area of Ammunition Depot, Gurugram and land owners are compelled to vacate the plots as per the Punjab and Haryana High Court’s judgement and if so, the details thereof;

(d) the total number of plots that are falling under the 300 metres of Ammunition Depot, Gurugram along with the fate of plot owners in this regard;

(e) whether the Government has any proposal to give compensation to the affected plot owners, if so, the details thereof and the time by which the Government will provide compensation or land in lieu of plots in some nearby areas; and

(f) the assistance provided to those plot owners whose plots are unbuilt since 2001 and are also falling within the ambit of 300 metres area of Ammunition Depot, Gurugram?

(a) Yes, Madam. Restrictions on constructions have been imposed around Ammunition Depots in the country under Works of Defence Act (WODA), 1903 and guidelines for issue of No Objection Certificate (NOC) for building constructions dated 18 May 2011, 18 March 2015, 17 November 2015 and 21 October, 2016.

(b) The details of Ammunition Depots where restrictions have been imposed under WODA, 1903 are attached as Annexure ‘A’. In remaining Military Stations / Cantonments, NOC Guidelines are applicable. The details in respect of Ammunition Depots in Barmer and Jaisalmer Districts of Rajasthan are attached as Annexure ‘B’.
(c) to (f): As per Gazette Notifications issued by Government of India vide SRO 12 dated 14 February, 2007 and SRO 4 dated 13 January, 2010, in consonance with WODA 1903, no building or structure shall be constructed, created or erected or no tree shall be planted on any land within the limits of 900 metres from the crest of the outer parapet of Indian Air Force Station at Gurgaon (Gurugram). The demarcation of land upto 300 metres from the outer parapet of Air Force Station Gurgaon (Gurugram) is in progress by Municipal Corporation of Gurugram on the directions of Hon’ble Punjab & Haryana High Court. After the restricted zone is demarcated from 900 metres to 300 metres, the total number of plots falling within 300 metres zone of Air Force Station Gurgaon (Gurugram) can be determined for further follow up action under WODA, 1903.
