Question : Shell Companies formed PostDemonetization

(a) whether the Government has identified the shell companies that came into existence post-demonetisation and if so, the details thereof;

(b) whether such shell companies have disqualified their Directors in them and if so, the details thereof;

(c) whether such disqualified Directors are politicians and Government Bureaucrats; and

(d) if so, the details thereof along with the list of such politicians and bureaucrats?

(a) to (d): The term Shell Company is not defined under the Companies Act. However, the Registrars of Companies (RoCs) have removed 2,24,733 companies from the register of companies up to 30.11.2017 after following the due process under Section 248 of the Companies Act, 2013. Further on account of operation of Section 164 read with section 167 of the Companies Act, 2013 a total of 3,09,619 Directors have been identified as disqualified directors up to 30.11.2017.
