Question : ILLEGAL ARRESTS



(a) whether the Government has received any complaint regarding involvement of police personnel in illegal arrests and detention in the country;

(b) if so, the number of such cases reported, guilty personnel arrested and the action taken against them during each of the last three years and the current year, State-wise;

(c) whether the Government has conducted any inquiry in this regard during the said period;

(d) if so, the details and the outcome thereof; and

(e) the steps taken by the Government to check such cases in future?

(a) & (b): As per the Seventh Schedule to the Constitution of India, “Police” is a State Subject. A statement showing state/UT wise details of case registered, police personnel charge-sheeted and police personnel convicted regarding complaint of illegal arrests and detention during 2011-2013 compiled by National Crime Records Bureau (NCRB) is attached as Annexure. The data for the year 2014 is at present not available with NCRB.

(c) to (e): It is primarily the responsibility of the State Governments to appropriately prevent and ensure non-occurrence of illegal detention. However, the Central Government has issued advisories from time to time to prevent misuse of powers by police.
