Question : Inspection of Factories

(a)whether the registered factories are regularly inspected under the Factories Act 1948 for ensuring compliance of various provision of the Act;
(b)if so, the details thereof along with the number of factories inspected during each of the last three years and the current year, State/UT-wise; including Odisha;
(c)the number of factories found to be declared hazardous/most hazardous during the said inspections;
(d)the action taken against such factories, State/UT-wise; including Odisha; and
(e)the other steps taken/being taken by the Government to ensure better and effective implementation of the provision of the said Act?

(a) & (b): Yes, the factories registered under the Factories Act, 1948 are inspected as per the provisions contained under Section 9 of Act. The inspections of such factories are carried out to ensure compliance of the various provisions of the Act. The enforcement of the provisions of the Act and the State Factories Rules framed there under is carried out by the respective State Governments through their State Factories Inspectorate/Directorate. The State/UT-wise number of factories inspected during the year 2012, 2013 & 2014 is enclosed as Annexure-I.

(c) & (d): As per the information collected from the Chief Inspector of Factories, the State/UT-wise, including Odisha, number of "hazardous process" factories for the year 2012, 2013 & 2014 is enclosed as Annexure-II and the State-wise prosecutions & convictions for the year 2012, 2013 and 2014 are enclosed in Annexure-III-A, Annexure-III-B & Annexure-III-C, respectively including prosecutions and convictions in respect of hazardous process industries.
(e): The State Factories Inspectorate/Directorate under the State Government are the enforcement authorities for the provisions under the Factories Act, 1948 and the Rules made thereunder. The State Governments are advised by the Ministry from time to time for effective enforcement of the provisions of the Act and the Rules framed thereunder.
